About these terms of use

The Multimedia Production Group of the ETH Zurich IT Services (MMP) is entitled to amend these terms of use at any time. Use of the video portal constitutes acceptance of the provisions in their current version.

Purpose of the video portal, participants

The video portal is part of the video distribution service and is subject to its services level agreement (SLA). It allows the publication of video material for the academic and general public. Thus, two patterns of use emerge: the provision of videos by owners and their use by users. Both groups have specific rights and obligations, which are explained below.

Providing videos

• Owners are responsible for the videos they upload. In particular, they are responsible for ensuring that they do not contain any illegal content or infringe the rights of third parties (e.g. copyrights, personal rights).
• The publication of the videos does not transfer any rights to ETH Zurich or MMP. The rights to the videos remain with the respective owners.
• The videos provided by the owners can be checked and viewed by the administrators of the platform at any time, even without their express permission. Videos that have been uploaded to the servers and violate legal provisions will be removed.

Use of videos

• All videos made available on the video portal are protected by copyright and may only be used for private, scientific and non-commercial purposes or in the context of teaching/learning; any further use is excluded.
• Restricted videos may not be passed on or made available to third parties.
• Videos marked with a Creative Commons (CC) license may only be used in accordance with the terms of the respective license.

Logging of activities, handling of data

• Activities within the video portal are logged in compliance with data protection legislation and the directive "Logging, evaluation and monitoring of log data at ETH Zurich" (RSETHZ 203.29).
• Owners of videos may have access to aggregated anonymised statistics on the use of their videos by users.
• The disclosure of private information such e-mail addresses to third parties is prohibited unless the user consents or such disclosure is required by law.

Web analysis service Matomo

MMP uses Matomo to analyze activities on the video portal. The data may be used for statistical purposes, to analyze learning behavior and to improve and further develop operations. Matomo is a web analysis service that uses cookies, text files that are stored on the user's computer and that enable Matomo to analyze usage behavior. The use of these cookies can be prevented by a corresponding setting in the browser.

Deletion of data, data location

• Log data is deleted after two years except for statistical data by Matomo.
• Videos are deleted in accordance with a separate .
• The servers of the video portal and Matomo are located at ETH Zurich; data is stored in the ETH Zurich network. 
• For other applications and cloud services connected to the video portal, the respective terms and conditions apply.

Change of the offer

MMP reserves the right to change or suspend parts or certain functions of the video portal at any time. MMP may restrict the use of and access to the video portal as well as the duration and scope of use at any time. MMP endeavors to keep downtimes as short as possible and to ensure that the intended functions are available at all times. However, users are not entitled to expect the video portal to be available at all times.

Liability

ETH Zurich and MMP assume no liability for the correctness, accuracy, up-to-dateness, reliability and completeness of the content of the videos. Users use the videos on the video portal at their own risk. Liability claims against employees of MMP or ETH Zurich for material or immaterial damage resulting from access to or use or non-use of the service offered, from misuse of the connection or from technical faults are excluded.
Owners are responsible for backing up their videos themselves. MMP is in no way liable for lost videos and any resulting damage or consequential damage. MMP regularly backs up the server, but cannot guarantee access to any data. ETH Zurich accepts no liability for any infringement of third-party rights.

Final provisions and sanctions

• In all other respects, the "Regulations for the Use of IT Resources at ETH Zurich (BOT) and Appendix" apply in their current version.
• MMP reserves the right to exclude users from using the video portal who do not comply with the terms of use.
